According to the labor law about obligatory social insurance the workers have the right for granting a holiday in connection with pregnancy, childbirth and payment of a grant which is estimated from average earnings of the worker.

Instruction

1. In 30 weeks of one-fetal pregnancy to the woman in consultation the disability leaf is given. In this case the term of the sick note is 140 calendar days: 70 days before childbirth and 70 – later. If pregnancy polycarpous, term increases to 194 calendar days, and the sick-list is issued in 28 weeks. In that case to the pregnant woman the disability leaf in 84 days prior to childbirth and for 110 days after them is given.

2. In 2011, changes which came into force since 2012 are made to the law on charge of grants and decretive. The women who went on a maternity leave in 2011 can choose charge of a grant in old or new option at discretion. So, in 2011-2012 the worker can choose charge of a grant in connection with pregnancy, childbirth, according to a former order from earnings for the last 12 months prior to the patrimonial holiday, and at absence of the period of work and earnings - proceeding from the size of an official salary. The second option - it agrees to the rules of calculation of grants introduced since 2011, decretive are charged proceeding from earnings for the last 2 years of work preceding year in which there comes a holiday. Therefore, in new option the salary received at the previous employers is considered.

3. At an initial stage determine the total amount of payments (income, salary) on which charges of insurance premiums in Social insurance fund for the last 2 years were made.

4. For calculation of a grant determine the sum of average day earnings. For this purpose divide the sum of the payments added in 24 months into 730 (irrespective of the days which are really worked by the worker).

5. For determination of the size of a day grant increase the sum of average day earnings by percent which is defined depending on an insurance experience.

6. Compare the turned-out sum of a day grant to its maximum size. If the grant calculated by you does not exceed a limit, then the size of maternity allowance is paid, proceeding from the calculated average earnings.
