How to prolong a child care leave

The paid child care leave is granted to the woman or the close relative before achievement of one and a half years by the child of age. Under the Article No. 256 of the Labor Code of the Russian Federation the woman can take an additional unpaid leave before achievement of three years by the child. All other holidays are established by the collective agreement or by agreement with the employer.

Instruction

1. For extension of a child care leave up to three years it is necessary to write the application. It can be given at once at writing of the application about granting a child care leave up to one and a half years. Or it is given separately, but not later than two weeks before the end of a holiday up to one and a half years.

2. It is necessary to specify terms of the beginning and the end of a child care leave to three-year age in the statement. To present it under the personal resolution the director.

3. For the woman the workplace remains, and it is impossible to terminate with her the labor relations.

4. After the end of a child care leave up to three years it is necessary to come to work or to take another vacation if it was not used earlier.

5. Further it is possible to take a vacation without contents, but no more than for 30 days. Such number of days as much as possible for granting a holiday within one year.

6. All rest of the time which is necessary for child care can be issued only in personal coordination with the employer.

7. The additional extension of a holiday exceeding term 3 years the labor law is not established. Therefore if the woman is going to stay at home with the child, she should leave.

8. The collective agreement can be established, provide - to mothers having many children, lonely, to mothers of disabled children an additional unpaid leave before achievement of 14 years by children of age. But strict instructions are in this respect not provided. Therefore this leave is granted not at all enterprises but only on those where it is established by the collective agreement.
