Renewal of the apartment or share of living space on the child since January, 2006 was simplified because the property donation duty was cancelled. In this regard to renew the apartment on the child by donation more simply and the cheapest way. But, nevertheless, the procedure of renewal rather difficult as demands big time expenditure.
Instruction
1. To renew the apartment or a share of living space on the full age child for a start it is necessary to collect a package of necessary documents, namely: • certificate on property on the apartment; • contract of privatization or contract of purchase and sale; • reference from BTI of the estimated cost of the apartment; • the reference from the tax inspection, in that case if the renewed apartment was descended to the owner or under the contract of donation earlier; • extract from personal account; • certificate of family composition; • certificate of absence of debt for utilities.
2. In case in the apartment the re-planning was made earlier, it is necessary to submit the documents from the housing organization confirming legality of the made re-planning. If the re-planning made in the apartment is not legalized, then collecting documents becomes complicated. In that case it is necessary will address to the housing organization for registration of the re-planning which is appropriately made in the apartment.
3. After all package of documents is built, it is necessary to address the notary for drawing up the contract of donation. At drawing up the contract of donation there have to be an owner of the apartment and the child on whom renew the apartment.
4. The package of documents and, the contract of donation signed in the presence of the notary, is given on registration in department of Federal registration service of the venue of renewal of the apartment to legalize the property right of the child.
5. If the apartment is renewed on the minor child, then it is necessary to attach the power of attorney from the child on acceptance of a gift to the above-mentioned package of documents. But, as the child minor, and has no right to issue such power of attorney, for him close relatives, for example the grandmother can make it. Respectively further the procedure of renewal of the apartment on the minor child will occupy the grandmother and, to accept the apartment in a gift on behalf of the child.
6. When the apartment is in common acquired property of two spouses, the consent of one of spouses to renewal of the apartment or a share of living space to the child will be required.
