Owing to various reasons many mothers refuse to take away children from maternity hospital. In this case the child can get to the house of the baby. That from there to take it, it is necessary to observe a certain procedure.
What is the adoption
In Ukraine the registration of the parental rights for the child by persons who are not his biological parents is considered adoption.
As a rule, minor children are subject to adoption. However there are cases when the court makes the decision on adoption of full age persons.
After adoption the child acquires the status of the son or daughter. The child can be adopted (is adopted) by both one person, and family. The child can be adopted also by the relatives. In Ukraine there is secrecy of adoption. It means that adoptive parents have the right for preservation in secret of all circumstances connected with adoption.
How to take away the child from the house of the baby
According to the legislation of Ukraine it is possible to take the child from the house of the baby when it reached two-month age. At the same time the age difference between the child and adoptive parents has to be not less, than 15 years. The procedure of adoption of the child from the house of the baby is as follows. Future parents need to receive the status of the candidate for adoptive parents. For this purpose it is necessary to file a petition to service for children at the place of residence. As a rule, these services are located in premises of regional councils or administrations. The weighty package of documents and references regarding the amount of income, the state of health, stay in marriage, a criminal record, a condition of living conditions of adoptive parents is enclosed to the application. If the child is adopted by one of spouses, on it the notarial consent of the second is necessary. The status of the candidate for adoptive parents is confirmed by the corresponding conclusion which is handed out.
Adopting the child, it is necessary to be ready to the fact that the service for children will periodically check as far as in new family his rights are observed.
After that it is necessary to choose the child and to receive the written consent to its adoption from administration of the house of the baby. During this period there is an acquaintance of future parents to the kid. In turn, the service for children starts processing of the provided package of documents. At this stage work on studying conditions of accommodation of adoptive parents is carried out, neighbors, fellow workers are interviewed. Also the package of documents, necessary for adoption, prepares also the house of the baby. If the service for children considers candidates for adoptive parents suitable, the conclusion about a possibility of adoption which is brought to trial is formed. Then it is necessary to appeal to court in the location of the house of the baby with the statement for adoption of the child. The procedure of adoption comes to an end in day of the introduction of the relevant decision of court in validity. Having the judgment on adoption, the child can be taken away from the house of the baby. Further, the child needs to make the new birth certificate and to give in passports of adoptive parents the corresponding marks about presence of children.
