But it is possible to make also continuous protection. In this case its height should not exceed 75 cm.
If the protection is located too close from windows of adjoining house and is capable to limit access of sunlight to its internal rooms, its admissible maximum height – 1.8 m. This requirement extends to solid fences which are called differently "deafs". The openwork or mesh protection located in close proximity to the house can be up to 2.1 m high. If the fencing is at sufficient distance from residential building and does not interfere with its full lighting by the sun, then height of such construction can be up to 2 m. This rule belongs to blind fences, openwork can be much higher. To avoid all misunderstanding and conflict situations, before construction of protection it is recommended to visit local authority and to find out what can be height of blind fence otherwise.
If the situation serious and controversial issue is resolved in court, the punishment measure for excess of height of fence is established by the judge. In addition, the sum defining the moral harm done to them can be collected from the violator. As the continuous protection is capable to shade strongly adjoining property, the caused damage can be and material. For example, if at the neighbor near fence the rare photophilous plant grows. Violations of norms of height of blind fence most often threatens with administrative fine and instructions to dismantle fencing and to bring it into the look conforming to requirements of the law. To avoid still heavy fines and other troubles, the careless builder is obliged to fulfill the requirements of municipality of domicile.
