What is the red line on the parcel

The red line, or C – the border between two adjacent sites separating the territory of private and general possession. In other words, it is like land surveying, but at C is more than legal rights, and at any disputes over occasion the territory will pay first of all attention to it.

In many practical cases the territory of the site on land surveying and the territory on C do not coincide therefore take two C types in attention:

  • Existing – the line defined on the basis of the law, issued documentary and recorded.
  • Design – C of temporality. Can acquire the rights in the future or it is changed.

Now it is necessary to talk about views of red lines and differences between them in practice in more detail.

The grade line or PL has no validity. It is just the scheme which demonstrates what will be planning of the territory in the future. In further PL it can be detached, changed or processed.

PL kind of says that the place is already taken for the subsequent buildings up to that moment, all will not be processed documents necessary for this purpose yet. The problem is in what time for it can be required much therefore most often borders and C can be changed or in general are erased. Therefore you should not consider PL as the final indisputable result.

The existing line or SETTLEMENT differs in the established coordinates and definition of its area. Such line is fixed by either buildings, or planning therefore it can be carried to objects of Cadastral chamber. Lines are registered by quality of established and undertake in accounting at delimitation of the territory.

It is necessary to understand that such the C is not capable to be boundary for the site with the general use. In most cases such border consists of several sites independent from each other.

Let C and consists of elements and parts of sites of the general and private use, it can be single independent object. C it is capable to protect decisions on plannings of territories in the future not to allow any violations connected with updating of borders of sites.

To define rated indicators of C, it is necessary to process documents. The following concerns those:

  • GPZU, or town-planning plan. In it C and the general planning are shown. The plan is necessary for the subsequent conducting works on the site. In most cases it is primary data source.
  • SPOZU – the scheme of the parcel with the drawn borders. At the same time borders are drawn before receiving construction permit of the house, construction or other objects. Allows to define further the zones admissible for construction.

Without these two plans it is impossible to begin construction and to define location of future house and all site together with borders and adjacent territories.
