1. The lease agreement of the real estate is signed in writing, the parties of the contract is the lessor and the tenant, the relations are governed by the Civil Code of the Russian Federation. The lease agreement can be signed both with physical, and with the legal entity. The contract isn't subject to notarization, but if the term of the contract exceeds one year, then the state registration of the lease agreement is obligatory. The contract can be signed also for the uncertain period, in that case the state registration isn't required.

With participation in the transaction of the legal entity more volume package of documents will be required including: statutory documents (charter and foundation agreement), certificate of state registration of legal entity (PSRN), certificate on assignment to the taxpayer of the identification number (INN). The protocol confirming powers of executive body when signing the contract (head of the organization), the fresh extract from the Unified State Register of Legal Entities, bank details of the organization.

3. The lessor has to provide to the tenant before signing of the contract the package of documents on a real estate object. Documents have to contain title and right supporting documents. On the basis of what the owner of a real estate object had a property right belong to documents of title. Treat such documents – the contract of purchase and sale, donation, individual share in construction, documents on privatization, the certificate on the introduction in inheritance, etc. The certificate on the property right is the right supporting document. Technical data sheet and the floor-by-floor plan of the room will help to understand the area of the object, it is a factor important as in most cases the price of the contract consists of the cost of one square meter of rent.

4. When signing the contract rent it is necessary to pay attention to slightly basic and obligatory provisions. The contract term, the cost of one square meter of the room leased of a condition about payment of utility bills, a possibility of increase in a rental rate, carrying out routine maintenance and overhaul repairs. It is important to provide an opportunity: transfers of the room to sublease, early termination of the contract, order and conditions of extension of term of the lease agreement.
