What documents are necessary at sale of the apartment in Ukraine

To sell the apartment in Ukraine, it is necessary to prepare rather volume package of documents. Without them the notary will not be able to certify the transaction and to issue property right transition

It is required to you

  • - passport; - documents of title on the apartment; - the expert opinion on apartment cost; - the registration certificate; - the reference from ZhEK; - the notarial consent of the second spouse.

Instruction

1. Receive in registration service in the place of the accommodation extraction from the State register of the real rights for real estate on the sold apartment. It certifies the property right to the apartment and it is necessary for transaction.

2. Order expert valuation of the apartment. It becomes within 2 weeks and is necessary for payment of tax on the income of natural persons at sale of the apartment and also for introduction of the payments connected with notarial certification of the transaction. Pay attention that the expert has to have the right to carry out such type of activity as property assessment for the purposes of taxation. The expert opinion is valid within 6 months.

3. Take the reference on the people registered in the apartment from the ZhEK. If minor children and also incapacitated persons live in it, for sale of the apartment the consent of tutorship and guardianship authority is necessary.

4. Before transaction pay tax on the income of natural persons at the rate of 5% of the selling price of the apartment which cannot be lower than its evaluation cost. Take details for payment of tax from the notary. Transfer it the receipt on payment of tax which will remain in notarial business.

5. Provide to the notary for check originals of documents of title on the apartment (contract of purchase and sale, the certificate on the property right, the certificate on the right for inheritance). If the apartment was got in defects, 2 spouses has to give the consent to its sale. It makes sure the notary during transaction. If the apartment was got in defects by spouses, both of them have to act as sellers. Write to the notary the application that you are not married or are divorced.

6. Study the draft agreement of purchase and sale of the apartment which was prepared by the notary. Introduce in it the remarks and additions. Subtract once again the contract of purchase and sale which is printed out on the form of the notary and sign it. Receive from the buyer money for the apartment and transfer to him the registration certificate and keys. Pay by agreement with the buyer the expenses connected with the notarial certificate of the transaction.
